WellTrack Terms of Service

1. Who this agreement is with

WellTrack is provided by DevzStudio, India (“we”, “us”). Contact: [email protected].

This agreement is between you and us only. It is not with Apple Inc. or Google LLC, and neither of them is responsible for WellTrack or its contents. See section 12 for what that means in practice.

2. Who may use WellTrack

You must be at least 13 years old, or the minimum age at which you can agree to terms like these on your own in your country, whichever is higher. If you are below that age, you may use WellTrack only with the involvement of a parent or guardian who accepts these terms on your behalf. If you are using it on behalf of an organisation, you confirm you are authorised to accept these terms for it.

3. Your licence to use the app

We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use one copy of WellTrack on devices you own or control, as permitted by the usage rules of the store you downloaded it from. This is a licence, not a sale: we and our licensors keep all rights in the app itself, including its code, design, artwork, illustrations, icons and name.

You agree not to: copy, sell, sublicense or redistribute the app; reverse engineer, decompile or disassemble it except where law expressly permits you to; remove or obscure any notice of ownership; use it to break any law; or interfere with its operation or with anyone else's use of it.

4. Your data is yours

Everything you put into WellTrack — your habits, your logged days, your notes, your profile picture — belongs to you. We claim no ownership of it and no licence to use it. It is stored on your own device; how that works, and the one optional stream of anonymous usage statistics, is described in our Privacy Policy, which forms part of these terms.

5. WellTrack Pro

Some features require Pro. The app currently offers Pro in three forms, and the price of each — in your own currency — is shown on the purchase screen before you buy, because only the store knows what your account will be charged:

• Monthly — an auto-renewing subscription, billed once a month.
• Yearly — an auto-renewing subscription, billed once a year, offered with a free trial where you are eligible for one. The exact trial length and your eligibility are decided by the store, not by us, and are stated on the purchase screen.
• Lifetime — a single payment, not a subscription. Nothing renews and there is nothing to cancel. It unlocks Pro for the store account that bought it, on any device signed into that account, for as long as the app exists.

Billing, renewal and cancellation

All purchases are processed by Apple (App Store) or Google (Google Play), not by us. We never see or handle your payment details.

• Payment is charged to your store account when you confirm the purchase, or at the end of any free trial.
• A subscription renews automatically for the same period unless you cancel it at least 24 hours before the current period ends. Renewal is charged within 24 hours of the period ending.
• You cancel in your store account — Settings → your name → Subscriptions on iOS, or Play Store → Subscriptions on Android — not in WellTrack. We cannot cancel a subscription for you.
• Cancelling stops future charges. You keep Pro until the end of the period you have already paid for.
• If you cancel during a free trial, you keep Pro until the trial ends and are not charged. Starting a second subscription may not come with another trial; the store decides that.

Refunds

Refunds are handled by the store that took your payment, under its own policy — Apple or Google. We have no ability to issue, reverse or expedite a store refund. Where your local consumer law gives you a right to withdraw from or cancel a purchase, that right applies and nothing here reduces it.

Price and feature changes

We may change what Pro costs, or what it includes, for future purchases and renewals. A price increase never applies to a subscription period you have already paid for, and the store will notify you and ask for your consent before renewing at a higher price where its rules require that. A lifetime purchase already made is not affected by a later price change. If we ever have to retire a feature that lifetime buyers paid for, we will say so in the app first and, where the change is material, offer a fair remedy.

6. WellTrack is not medical advice

Decisions about your health are between you and a qualified professional. Do not delay or avoid seeking care because of anything WellTrack shows you. If you are in crisis or think you may have a medical emergency, contact your local emergency service.

7. Notifications

WellTrack can schedule reminders and check-ins on your device. Whether they arrive, and when, depends on your operating system, your notification permissions and the state of your device — battery saving, focus modes and background restrictions can all delay or suppress a notification, and none of that is under our control. Do not rely on WellTrack for a reminder that must not be missed, such as taking medication on schedule.

You control every category of notification in Settings → Notifications, and can revoke the permission entirely in your device settings.

8. Availability and changes to the app

We work to keep WellTrack working well, but we do not promise it will be uninterrupted, error-free, or available forever. We may add, change or remove features, and we may require you to install an update in order to keep using the app — in particular, a build old enough to have stopped working correctly may be asked to update before it will run.

If we ever discontinue WellTrack entirely, we will give notice in the app where we reasonably can, and the export feature will remain available so you can take your data with you.

9. Disclaimer of warranties

To the fullest extent the law allows, WellTrack is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will meet your requirements, that its statistics or streak calculations are free of error, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties or of implied statutory rights. Where that is the case, the exclusions above apply only to the extent permitted, and your non-excludable rights under your local consumer law are unaffected.

10. Limitation of liability

To the fullest extent the law allows, neither we nor our suppliers are liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost goodwill, or lost data, arising out of or relating to your use of WellTrack — even if we have been advised of the possibility.

Our total liability for all claims relating to WellTrack is limited to the greater of (a) the amount you actually paid us or the store for WellTrack in the 12 months before the claim arose, or (b) USD 50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation.

11. Ending this agreement

You can end it at any time by deleting the app. We may suspend or end your licence if you materially breach these terms, and we will give notice where it is reasonable to do so. Sections 4, 9, 10, 12 and 13 survive the end of this agreement. Ending the agreement does not entitle you to a refund except as required by law or by the store's own policy.

12. Terms required by the app stores

Apple (App Store)

Where you obtained WellTrack from the App Store, you acknowledge and agree that:

1. These terms are between you and DevzStudio only, and not with Apple. Apple is not responsible for WellTrack or its contents.
2. Your licence to use WellTrack is limited to a non-transferable licence to use it on Apple-branded products you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions.
3. DevzStudio, not Apple, is solely responsible for maintenance and support of WellTrack. Apple has no obligation to provide any maintenance or support services for it.
4. In the event WellTrack fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (where one was paid) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to WellTrack, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are DevzStudio's sole responsibility.
5. DevzStudio, not Apple, is responsible for addressing any claim by you or a third party relating to WellTrack or your possession and use of it, including product liability claims, any claim that WellTrack fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
6. In the event of a third-party claim that WellTrack or your possession and use of it infringes that party's intellectual property rights, DevzStudio — not Apple — is solely responsible for the investigation, defence, settlement and discharge of that claim.
7. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. You must comply with any applicable third-party terms of agreement when using WellTrack.
9. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce them against you.
10. Apple may provide your contact information to DevzStudio in connection with any question, complaint or claim regarding WellTrack.

Google (Google Play)

Where you obtained WellTrack from Google Play, these terms are between you and DevzStudio only. Google is not a party to them, is not responsible for WellTrack, and provides no warranty or support for it. Your use of the app is also subject to the Google Play Terms of Service, and purchases are subject to Google Play's payment and refund policies.

13. Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-law rules. Any dispute arising out of or relating to them is subject to the exclusive jurisdiction of the courts at Kerala, India.

If you are a consumer resident in the EEA, the UK, or another jurisdiction whose law gives you the right to bring proceedings in your own local courts and to the protection of your own mandatory consumer law, this section does not take that right away from you.

14. Changes to these terms

We may update these terms. When we do, we will update this page and the “Last updated” date above, and where a change materially affects your rights we will give notice in the app before it takes effect. Continuing to use WellTrack after a change takes effect means you accept the updated terms. If you do not accept them, stop using the app and cancel any subscription.

15. Everything else

These terms, together with the Privacy Policy, are the entire agreement between us about WellTrack, and replace any earlier understanding. If any provision is held unenforceable, the rest stays in force and the unenforceable provision is limited to the minimum extent necessary. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets, on notice to you.
